Quick answer: The common norm in Hyderabad is a refundable security deposit of 2 to 3 months’ rent for family rentals, and sometimes higher for premium furnished flats. Deposits in some other metros, such as Bengaluru, are often higher. Deposits must be returned at move-out after deducting agreed damages and dues.
Put the deposit amount, deduction conditions and refund timeline explicitly in the rental agreement, and collect payment receipts. If an owner asks for more than 6 months’ rent as deposit in a normal locality, treat it as a red flag and negotiate.
Is there a legal cap on rental deposits in Telangana?
Not one we could confirm. The central government’s Model Tenancy Act, 2021 suggests a ceiling of two months’ rent for residential lets. But it is a model law that each state must choose to adopt, and we found no Telangana notification adopting it. In practice, the deposit in Hyderabad is whatever owner and tenant agree in writing. That makes the agreement itself your main protection.
What pushes the deposit up or down?
| Factor | Tends to increase the deposit | Tends to reduce it |
|---|---|---|
| Furnishing | Fully furnished, with appliances | Unfurnished or semi-furnished |
| Tenant profile | Bachelor sharing, short stays | Company lease, families with a long lock-in |
| Locality and demand | High-demand IT corridors and gated communities | Areas with more vacancies |
| Rent level | Owner wants a lower rent in exchange for a higher deposit | A slightly higher rent in exchange for a lower deposit |
| Pets, interiors, high-value fittings | Owner seeks extra cover for damage | A detailed inventory and condition photos agreed at move-in |
Use these as negotiation levers. A tenant offering a longer lock-in or a company lease can often negotiate a smaller deposit.
How do I protect my deposit?
- Pay by bank transfer, never in cash, and keep the transaction reference.
- Record in the agreement the exact deposit amount, what can be deducted (unpaid rent, utility dues, damage beyond normal wear and tear), and the refund deadline after you hand back the keys.
- Agree painting and cleaning charges upfront, as a fixed sum or as “actuals with bills”, so they are not a surprise at move-out.
- Do a dated photo and video walkthrough with the owner at move-in, and attach the inventory to the agreement.
- Make sure the agreement is properly stamped. A deposit described as an “advance” may affect the stamp duty, so ask your drafter. Telangana’s registration fee and duty rules are summarised in registration charges in Telangana.
- Give notice in writing as the agreement requires, and settle utility bills before you leave.
What deductions are fair at move-out?
Fair deductions are unpaid rent, unpaid electricity, water or maintenance, and repair of damage beyond normal wear. Agreed painting costs also count. Fading paint, minor nail holes and the normal ageing of fittings are usually treated as wear and tear, unless the agreement says otherwise. Ask for bills for any large deduction. If you disagree with a deduction, raise it in writing straight away and attach your move-in and move-out photos. Most disputes settle quickly once both sides are looking at the same evidence. A broker who handled the rental can often mediate before things escalate.
What should owners keep in mind?
A very high deposit does not always serve the owner well. It can keep good tenants away and lengthen vacancies, and every month a flat sits empty costs rent. Owners usually do better with:
- A deposit in line with the locality, plus a clear written list of what can be deducted
- A detailed inventory and condition photos signed by both sides at move-in
- A reasonable lock-in and notice period, so the tenant cannot leave without warning
- Receipts for every payment, and refunds made by bank transfer
- A prompt refund within the agreed timeline. Prompt refunds help an owner find good tenants next time
Tenant checks help too. Collect ID and employment or business details, and keep copies with the agreement.
Frequently asked questions
Is the owner required to pay interest on my deposit?
Not unless the agreement says so. Most Hyderabad agreements treat the deposit as interest-free and refundable.
Can the owner adjust the deposit against my last month’s rent?
Only if you both agree. Many owners refuse because it leaves nothing to cover damage. Put whatever you agree in writing.
What if the owner does not return the deposit?
Send a written demand with your agreement, payment proof and move-out photos. If that fails, a lawyer’s notice and civil remedies are available. Good paperwork is what makes these work.
Are deposits different for commercial spaces?
Yes. Shops and offices usually carry higher deposits and longer lock-ins than homes, and terms vary widely. Negotiate them separately.
