How does rental agreement e-stamping work in Telangana and what does it cost?

Rental Agreement E-Stamping — How it works in Telangana and what it costs | Broker Network

Quick answer: Telangana rental agreements are usually made for 11 months (which avoids compulsory registration) on e-stamp paper. The stamp duty for rental agreements is a small percentage of the annual rent – modest in absolute terms for typical Hyderabad rents – plus drafting and notarisation charges if you choose to notarise.

The agreement should clearly record rent, deposit, notice period, maintenance responsibility, lock-in and escalation. Rates and procedures change, so confirm the current stamp duty on the Telangana registration department portal or ask us – Broker Network can draft and e-stamp a compliant agreement for you.

How much stamp duty does a Telangana rental agreement cost?

The Telangana registration department’s ready reckoner lists these rates for leases:

Lease termStamp dutyRegistration fee (if registered)Calculated on
Less than 1 year0.4%0.2%Total rent for the term
1–5 years, residential0.5%0.2%Average annual rent
5–10 years, residential1%0.2%Average annual rent
Fine, premium or money advanced in addition to rent2%0.2%That amount, on top of the duty on rent

Worked example (illustrative): for an 11-month agreement at ₹30,000 a month, total rent is ₹3,30,000. Stamp duty at 0.4% comes to ₹1,320. If you also choose to register, the 0.2% fee adds ₹660. Some agreements describe the refundable security deposit as an “advance”, which could attract duty under the 2% row. Ask the Sub-Registrar office (SRO) or your drafter how your deposit clause will be treated. Rates are revised from time to time, so check current rates on registration.telangana.gov.in before you pay.

How do you actually stamp the agreement in Telangana?

  • Non-judicial stamp paper: the department says papers of ₹10, ₹20, ₹50 and ₹100 are available from licensed vendors, SROs and post offices. Higher duty is made up through a challan.
  • Challan payment: the agreement can be printed on plain paper and the duty paid by challan. The department’s FAQ explains when the District Registrar certifies such documents.
  • E-stamps: the registration portal publishes an e-stamps user manual. Ask your vendor or drafter whether they can issue an electronic stamp certificate for your agreement.

Whichever method you use, the stamp must be bought before or when the agreement is signed, in the name of one of the parties.

Do I need to register an 11-month agreement?

Under the Registration Act, leases from year to year, or for more than a year, must be registered. That is why most Hyderabad rentals use 11 months. A shorter agreement can still be registered voluntarily for a 0.2% fee, which gives you stronger evidence if there is a dispute. Registration fees for other property documents are covered in registration charges in Telangana.

What must the agreement say?

  • Names, ID details and addresses of the owner and tenant, and the full flat address
  • Monthly rent, due date, and the escalation on renewal
  • Security deposit amount, permitted deductions and the refund timeline
  • Who pays maintenance, electricity, water and minor repairs
  • Lock-in period, notice period, and painting or cleaning terms at move-out
  • An inventory of fittings and furniture, with photos attached

What happens when the 11 months are up?

An 11-month agreement does not renew itself just because you stay on. Most owners and tenants sign a fresh agreement on fresh stamp paper for the next term. The stamp duty is worked out again on the new total rent. Before renewing:

  • Apply the escalation agreed in the first agreement, or negotiate a new one, and record it.
  • Record in writing that the existing security deposit carries over, so there is no question of paying it twice.
  • Update any changes, such as new furniture, a new maintenance arrangement or additional occupants.
  • If you have rented the same flat for several years, consider a registered agreement of 1–5 years. For residential property, the ready reckoner charges 0.5% stamp duty on the average annual rent, and the longer term gives both sides more certainty.

Frequently asked questions

Who pays the stamp duty, owner or tenant?

The Telangana department’s FAQ says the lessee (the tenant) pays for a lease unless the parties agree otherwise. Many owners and tenants split it, so write down whatever you agree.

Is notarisation mandatory?

No law requires it for an unregistered 11-month agreement. It is optional and adds some evidentiary comfort. Registration gives much stronger proof.

What happens if the agreement is not stamped?

According to the department, an unstamped or under-stamped document cannot be admitted in evidence. If it is impounded, the duty is collected along with a penalty of up to ten times the shortfall.

Are online rent agreements valid?

Yes, if they are properly stamped for Telangana and signed by both parties. Check that the stamp is a Telangana stamp, not another state’s.
